Prohibited Items

1. Scope

ToolPool.Garden exists for lending: tools, gear, supplies, and whatever else a pool calls the things it shares. The categories below may not be listed, offered, or lent through the platform, whether the listing is public or unlisted. "Listing" includes describing an item in a chat with the intent to lend it, not just creating a listing record. This list is part of the Acceptable Use Policy.

This list is not exhaustive. We may remove any listing that is illegal to lend, dangerous to lend, or inconsistent with the purpose of the platform, even if it is not listed below. When in doubt, ask [email protected] before listing.

If something is not on this list, that does not mean we have approved it. Plenty of what gets lent takes a license, insurance, training, or plain competence to use, and we check none of it: we do not verify licenses, coverage, or experience, and we are not a party to any loan. The owner decides whether a borrower is equipped for what they are borrowing, and the borrower is responsible for using it legally.

2. Weapons

• Firearms of any kind, including frames, receivers, and complete parts kits; ghost-gun kits and 3D-printed firearm files.
• Ammunition, magazines, suppressors, and firearm accessories whose transfer is regulated.
• Explosives, blasting agents, detonators, commercial-grade fireworks, and pyrotechnic devices.
• Items regulated under the National Firearms Act or equivalent state law (destructive devices, short-barreled rifles or shotguns, and so on).
• Weapons designed or marketed for use against people: batons, brass knuckles, swords, switchblades and other prohibited knives, crossbows and bows sold as weapons, stun guns, and tasers.
• Chemical weapons and dispersal devices, including consumer pepper spray (which is not a tool and may not be listed).

Ordinary cutting and striking tools with a legitimate work purpose (utility knives, chisels, axes, machetes used as clearing tools, nail guns, chainsaws) are not weapons for the purposes of this section. The rest of the list still reaches them: one that has been recalled, or that has had its guards taken off, is barred by section 5. Describe their condition honestly, and use the borrow chat's experience and protective-equipment checklist item before handing them over.

3. Regulated Goods

All account holders are 18 or older. Whether a particular loan is lawful between the two of you is yours to settle, and we do not check it. Not checking is not the same as allowing: anything illegal to possess or transfer where either of you lives may not be listed, as section 6 says. What follows is narrower than that, and names categories where lending through the platform is a different kind of risk than lending a circular saw.

• Prescription-only medical devices, and prescription drugs or drug paraphernalia.
• Alcohol, tobacco, cannabis, and vaping products.
• Radioactive sources, and industrial x-ray or laser equipment above consumer classes.
• Restricted-use pesticides and fumigants, whose handling and disposal duties outlast the borrow.
• Lock picks, bump keys, and other entry or bypass tools where the listing appears aimed at unlawful entry.

Needing a license, a permit, insurance, or training is not by itself a reason an item cannot be listed. Welders, chainsaws, wood chippers, scaffolding, a truck or a trailer are ordinary things to lend, and none of them is barred for that reason alone. Any of them can still fall under another part of this list, or be removed under section 1. Whether this borrower has what the thing calls for is between the two of you, and the borrow chat's experience and protective-equipment checklist item is where it gets settled.

4. Stolen Goods

A tool or a skill does not name its owner to other users until the owner chooses to reveal themselves. That anonymity is a privacy feature for lenders, and it must never become cover for moving stolen property. Accordingly:

• You may only list items you lawfully own or are expressly authorized by the owner to lend.
• Items with removed, altered, or defaced serial numbers may not be listed under any circumstances.
• Do not list items you found, items pending an insurance claim as lost or stolen, or items acquired in circumstances that would make a reasonable person suspect they were stolen.
• Anonymity does not extend to the platform or to legal process. We know which account owns every listing, we keep an audit trail, our staff can inspect any listing and its photos, and we cooperate with law enforcement investigating stolen property in response to valid legal process.
• If you believe a listed tool is stolen (for example, you recognize a distinctive tool of yours), report the listing in-app or email [email protected], and file a police report.

Where we suspect fencing we remove the listing, and we may disable the account and refer the matter to law enforcement.

5. Unsafe and Recalled Items

• Items subject to a safety recall that has not been remedied.
• Tools lent with removed or disabled safety guards, interlocks, or dead-man switches.
• Items containing exposed asbestos, significant lead-paint hazards, or other materials that make ordinary handling unsafe.
• Compressed-gas cylinders and fuel containers that are out of certification or visibly damaged.

6. Not a Marketplace

A listing offers something you own for someone to borrow, offers a skill you are willing to teach, or asks for something you need. No money moves between users through the platform, and none of the three may become an offer to sell, rent, or hire out. Charging for a borrow around the platform is barred too: a pool's monthly subscription pays for running the pool, and it is not payment for the use of anything lent. A listing crosses the line when, for example:

• It carries a price, a payment link, or a fee to hand the item over, or it is posted to move stock.
• It rents rather than lends, including a cost-recovery arrangement written up as a loan.
• It offers real estate or storage space, or sells labor rather than teaching a skill.
• It offers an animal, or a plant regulated as noxious or invasive.
• It offers counterfeit goods, or media and electronics for copying or circumvention.
• It offers anything illegal to possess or distribute in either party's jurisdiction.

7. Enforcement

We may remove any listing that violates this list, warn or disable the account that posted it, and report unlawful items to law enforcement. Platform staff can audit any listing, including unlisted tools, regardless of pool membership. Repeated or knowing violations can lead to account deletion. What we do in a given case is our decision, weighed as the Acceptable Use Policy describes.
